Appeals Council

Charlotte Social Security Disability Appeal Lawyers

If the Administrative Law Judge denies your claim, there is still one more step in the administrative process. You can ask the Appeals Council to review the ALJ’s decision. The Appeals Council is another part of the Social Security Administration’s disability review process, and it provides you your last chance for review by SSA.

What Does the Appeals Council Do?

If you disagree with the ALJ's decision, you can ask the Appeals Council to take a look at the decision and see if additional action needs to be taken. The Appeals Council might find there is no reason to reopen the ALJ decision. It might decide there were errors made at the hearing and send your case back for another hearing. It might even decide that the ALJ was wrong and award you benefits.

At the Charlotte law office of Hempson & Zupanec, we can represent you at this stage of the proceedings. Many attorneys who handle Social Security Disability Insurance (SSDI) and Supplemental Security Income (SSI) cases will not represent clients at the Appeals Council, even if they have handled the case up to that point. If we file an appeal with the Appeals Council, we will see if there is additional relevant evidence to submit.  We will prepare a brief explaining why we think the ALJ was wrong in denying you benefits.

This is one more stage at which an experienced attorney can make a difference in your case. Our attorneys handle only disability cases and have the experience and expertise that you need.
