The Basics of the VA Benefits Process

While one of our veterans benefits lawyers will sit with you during your initial consultation to explain in detail what the process will look like, it is important for you to have a basic understanding of what you will face before you meet with us.

1. Application for Compensation: Completing this application is the first step you must take in applying for veterans disability benefits. Your application, which requires several forms and past military and medical records, must be sent to the local VA office. While the VA is required to assist veterans who are trying to get disability benefits, individual employees do not always offer clear or even accurate information. That is why having a lawyer is so important. Once the VA has everything it needs, it will review your file and issue a ruling either granting or denying benefits.

2. Notice of Disagreement: If you are denied veterans disability benefits, or if you feel the rating decision you have been given is too low or the effective date is wrong, you can appeal by filing a Notice of Disagreement within one year. You can submit additional medical information or records to be considered on appeal, and the VA will consider the new information. It is important to prepare your Notice of Disagreement carefully. We can help you with this step, even if we were not involved in your original application process.

3. Appeals: If the VA continues to deny you benefits, we can appeal to the Board of Veterans’ Appeals (BVA) or even the U.S. Court of Appeals for Veterans Claims (CAVC).
